NORTH MANKATO (TEC News) – Acting on a tip of a suspicious vehicle, a Fairmont man is in jail after North Mankato police found him having sex with a 13-year-old Blue Earth County girl.
The criminal complaint identifies Matthew James Martinson as a 33-year-old man, however his listed birthdate would make him 32-years-old.
Regardless, Martinson is facing five felony counts of Criminal Sexual Conduct, including two 1st Degree counts involving a victim under 13 years of age and a victim under age 16 where there is a significant relationship.
According to the criminal complaint filed in Nicollet County District Court in St. Peter, North Mankato Police Lt. Carl Boch approached the suspicious vehicle parked at the end of an unidentified dead end street and the engine was running.
Police made contact with the driver, who was later identified as Martinson, and determined the couple had been “parking.” However police removed Martinson from his car and placed him in the squad car because the female appeared to be young.
Boch was able to identify the female as being 13 years old.
Police noted that Martinson was found with his pants undone and the girl was also in a state of undress.
The girl initially denied there has been any sexual contact.
Martinson was taken to police headquarters where he was interviewed and allegedly admitted to receiving oral sex from the girl in the car.
Court records say Martinson disclosed he had been in a prior relationship with the girl and the two had developed “a bond.” Martinson also told investigators of five prior contacts with the girl her mother’s home in Blue Earth County. But he denied they had intercourse.
Court minutes from Martinson’s hearing today indicate information has been forwarded to Blue Earth County prosecutors for possible additional charges.
The girl later told police that in addition to having oral sex around four times, she had intercourse with Martinson at least ten times in her home for the last two years, making her 11 or 12 years old.
When police later informed Martinson when the girl has disclosed, he allegedly replied “how could you actually imagine that I would admit that, I know right from wrong.”
Conditional bail for Martinson has been set at $150,000. Those conditions include no contact with minors.
Martinson told the judge he has his own children with “50/50” visitation with his oldest and no parenting time with his youngest.
Court records don’t indicate how old his children are.
