Mankato Man Accused Of Sex With Mentally Impaired Teen



MANKATO – A 46-year-old Mankato man’s hospital visit after taking a couple dozen Benadryls led to revelations of his alleged relationship with an underage teenage boy.

 
Bail was set Monday afternoon at $75,000 for 46-year-old James Daniel Kirlin. He faces five felony counts of criminal sexual conduct involving a victim who was both a minor and mentally impaired.
 
Police were called to ISJ on September 28, 2010 after Kirlin went to the emergency room having taken 20 to 25 Benadryl. He to ISJ staff that he had “lost a loved one” and had been dating a 16-year-old for the last nine months.
 
After he was transferred to the New Ulm Medical Center, he allegedly told staff the victim was 15 when they met, but waited until he turned 16 to have sex.
 
In December 2010 , the victim described Kirlin to police as a “weird person” and that Kirlin gave him oral when he was 15 and showed him gay porn on his computer. Kirlin also allegedly took nude photos of the boy.
 
Kirlin told police he first met the boy in October 2009.
 
Kirlin allegedly admitted to police that he knew the victim was on medication for ADHD and had anger issues. Special education officials from the victim’s school said he lacked the judgment to “give reasoned consent.”
 
During Monday’s hearing, Kirlin disclosed he works for a home health service company in Mankato.
 
Kirlin’s public defender said her client is “denying these charges.”
 
In asking for a high bail, prosecutors said the victim “is fearful of the defendant.”
